After a sexual assault at an Airbnb or other short-term rental, you may be trying to process what happened while facing decisions you never expected to make. You don’t have to make all of them right away. Your safety, health, and well-being come first.

When you feel ready, some steps may help preserve your legal options, such as saving information about the Airbnb and learning whether the host, property owner, Airbnb, or another party may be responsible.

Key Takeaways

  • Your immediate safety and medical needs come first after an Airbnb sexual assault.
  • There is no “right” way to respond to sexual assault, and you don’t have to make every decision immediately.
  • Airbnb booking records, messages, property-access information, photos, and other records may become important evidence.
  • Reporting an assault to Airbnb and reporting it to law enforcement are separate decisions.
  • A California Airbnb sexual assault attorney can investigate what happened and help you understand your legal options without pressuring you to pursue a claim.

An Airbnb stay should be a place where you feel safe. When a sexual assault happens at a vacation rental, that sense of security can disappear in an instant. And if you’re away from home, you may also be in an unfamiliar place without the people and resources you normally rely on.

If this happened to you, I want you to know something before we talk about evidence, police reports, Airbnb, or lawsuits. There’s no checklist you have to complete to have responded to sexual assault the “right” way. Survivors react in many different ways. You might seek help immediately, freeze, leave, or stay where you are because you don’t know where else to go. You might remember every detail or have gaps in your memory. There’s no single way people respond to trauma.

What you do next is your decision. The information below is here to help you understand some of your options—not to tell you what you should have done or what you must do now.

Focus on What You Need to Feel Safe

If you’re still at the Airbnb and don’t feel safe, consider moving somewhere you feel more secure if you’re able to do so. That could be another rental or hotel, a public place, a hospital, a police or fire station, or the home of someone you trust.

If you believe you’re in immediate danger, call 911. You may also want to call someone you trust who can stay with you, pick you up, or simply be there while you decide what to do.

Being assaulted while traveling can make an already traumatic experience even more disorienting. You’re in a place that may be unfamiliar, without your usual transportation or people you trust nearby. And in that moment, you may simply want to get home.

“One of the first things I tell survivors is that you don’t have to solve everything today. If you’re safe, start there. We can help you work through the other questions when you’re ready.” — Jessica Pride

Medical Care Is About Taking Care of You

You may choose to seek medical care after a sexual assault. A healthcare provider can evaluate injuries, discuss testing or treatment for sexually transmitted infections, and address pregnancy concerns when applicable.

You may also be offered a forensic examination, sometimes called a rape kit. A specially trained medical professional may document injuries and collect potential forensic evidence. You can ask questions about what is happening, and you can communicate if you don’t want a particular part of the examination performed.

Some sexual assault survivors want to shower, bathe, change clothes, brush their teeth, or otherwise clean themselves afterward. These are understandable responses. If you think you may want a forensic examination and can wait, preserving clothing and avoiding washing may help preserve evidence.

If you’ve already done any of those things, please don’t assume you’ve lost the opportunity to seek care or have evidence collected. You can still go to a hospital or other appropriate medical provider and ask about your options.

“I never want a survivor to think, ‘I showered, so I ruined my case,’ or ‘I waited, so no one will believe me.’ What you did after the assault was your response to an incredibly traumatic experience. Talk to us about what happened, and we can look at what evidence may still be available.” — Jessica Pride

When You’re Ready, Preserve What You Can From the Airbnb Stay

Evidence matters, but I don’t expect someone who has just experienced a sexual assault to suddenly think like an investigator. If gathering information feels overwhelming, you don’t have to do everything at once or by yourself. Someone you trust may be able to help. If you contact an attorney, the legal team can also help determine what should be preserved and what additional evidence may exist.

Digital records can be especially useful in an Airbnb sexual assault case because they may help answer important questions later: Who controlled the property? Who could access it? What security measures were represented to guests? Were there prior communications or concerns?

If you’re able, consider preserving:

  • Your Airbnb reservation and booking confirmation. Save booking receipts, reservation details, and other records showing where and when you stayed.
  • The Airbnb listing. Take screenshots of the listing, including photographs, the property description, safety features, house rules, and information about the host or property manager.
  • Messages and other communications. Preserve Airbnb messages with the host or property manager, along with relevant texts, emails, call logs, and social media messages from before or after the assault—even if you’re unsure whether they matter.
  • Check-in and access information. Save key codes, lockbox instructions, smart-lock information, and other details showing how you or others could enter the property.
  • Photos or videos of the property. If you have them, preserve images showing doors, windows, locks, cameras, lighting, damaged security features, or other conditions that could become relevant later.
  • Receipts and other records. Keep records of alternative lodging, transportation, medical care, or other expenses related to what happened.

Try not to delete communications or alter original files. And don’t worry about determining what is or isn’t “good evidence” yourself. That’s something an attorney can help you evaluate.

Should You Report the Sexual Assault to Airbnb?

Airbnb provides safety resources for guests who experience serious incidents during a stay, including a 24-hour safety line. If you decide to make a report, save the case or reference number and the names of anyone you communicate with. Keeping your own record can be important.

You may also want legal advice before providing lengthy written or recorded statements. An attorney can help you understand what information may be important to share and preserve.

One distinction I want survivors to understand is that reporting an assault to Airbnb and reporting it to law enforcement are not the same thing. They are separate decisions, and making one report doesn’t mean you’ve made the other.

Do You Have to Report an Airbnb Sexual Assault to Police?

No survivor should be made to feel that the legitimacy of their experience depends on how quickly they called the police—or whether they called at all.

There are many reasons someone may report immediately, wait to report, or decide not to make a police report. Trauma can affect memory, communication, decision-making, and the way someone responds during and afterward.

If you’re unsure what you want to do, you can speak with an attorney about how a police report may relate to your legal options. A civil sexual assault claim and a criminal investigation are different processes, and a civil claim doesn’t necessarily depend on a criminal conviction.

“Survivors sometimes come to me worried that because they didn’t immediately call the police, they no longer have options. I want them to talk to us before making that assumption. Every case is different, and we look at the full picture—not just one decision someone made in the aftermath of trauma.” — Jessica Pride

When Should You Contact a California Airbnb Sexual Assault Attorney?

Female attorney sitting on a couch and taking notes while consulting with a female client in deep thought. You don’t need to figure out who was legally responsible before calling an attorney. In fact, that’s our job.

When the Pride Law Firm team looks at an Airbnb sexual assault case, we want to understand much more than the assault itself. We look at the property, who owned and managed it, who had access to it, what security measures were in place, what Airbnb and the host may have known, and whether there were warning signs or previous incidents that should have prompted action.

Depending on the circumstances, we may ask:

  • Who owned, operated, managed, or controlled the rental property?
  • Who had access to the Airbnb during the stay?
  • Was the alleged assailant a host, co-host, property manager, employee, contractor, guest, or someone else?
  • Were locks, cameras, entry systems, or other security measures functioning properly?
  • Were representations about the property’s security accurate?
  • Were there previous complaints or incidents involving the host, property, or alleged perpetrator?
  • What did Airbnb, the host, property owner, or other potentially responsible parties know before the assault?
  • Did someone fail to take legally required or reasonable action under the circumstances?

An assault occurring at a vacation rental doesn’t automatically make Airbnb legally responsible. Liability depends on the facts, the relationships between the parties, applicable law, and the evidence.

That’s why investigating early can sometimes matter. Electronic records, surveillance footage, access information, and other evidence may not remain available forever.

Who Could Be Held Responsible for a Sexual Assault at an Airbnb?

One of the first questions survivors often have is: Who can actually be held responsible for what happened to me? The person who committed the assault may not be the only person whose conduct needs to be investigated. Depending on what happened, a property owner, host, property manager, employer, business, or another person or entity may have played a role in creating or failing to address an unsafe situation.

Claims involving Airbnb itself require careful investigation of the specific facts and applicable law. This is not something you should have to untangle on your own. A California sexual assault attorney can investigate those relationships and determine whether there may be grounds for a civil claim.

When a claim is available, a survivor may seek compensation for medical or mental health treatment, lost income, pain and suffering, and other damages under California law.

For some survivors, a civil case can also be a means of seeking accountability. For others, pursuing a lawsuit may not feel right. Our role is to explain your options and help you make an informed decision, not to pressure you into one.

FAQs About What to Do After an Airbnb Sexual Assault

What should I focus on first after an Airbnb sexual assault?

Your immediate safety and well-being come first. If you believe you’re in danger, call 911 or, if you can, move somewhere you feel safer. You may also want to contact someone you trust. You don’t have to make decisions about reporting the assault or taking legal action immediately.

Should I go to the hospital after an Airbnb sexual assault?

You can seek medical care even if you don’t have visible injuries. A healthcare provider can address injuries and other health concerns and discuss whether you want a sexual assault forensic examination. Getting medical care doesn’t commit you to pursuing a lawsuit.

What if I already showered or changed clothes after the assault?

You can still seek medical care and ask about a forensic examination. Don’t assume that showering, changing clothes, or taking other steps after the assault means it’s too late to seek care or explore your legal options.

What evidence should I save after an Airbnb sexual assault?

If you’re able, preserve your Airbnb reservation, the property listing, messages with the host, access instructions, photographs, videos, receipts, and other relevant communications. Don’t worry about figuring out what matters on your own. An attorney can help identify and preserve additional evidence.

Do I have to report an Airbnb sexual assault to police?

Whether and when to report an assault to law enforcement is a personal decision. If you’re uncertain, an attorney can explain how reporting or not reporting may relate to your legal options.

Can I sue Airbnb after a sexual assault?

An attorney can investigate Airbnb’s role, the host and property owner, property security, prior complaints, access to the rental, and other evidence to determine whether a civil claim may be available.

How can a California Airbnb sexual assault attorney help?

A lawyer can help preserve evidence, investigate the property and people involved, identify potentially responsible parties, and explain your legal options. But perhaps most importantly at the beginning, an attorney can help answer your questions so you don’t have to figure out what comes next alone.
